Step-by-step guide to getting a divorce

Step 1: Make an Application to the Court

  • This can be done as a sole or joint application.

 

Step 2: Application Review

  • The Court reviews and approves the application.

 

Step 3: Sole Application

  • The Court sends a copy of the Divorce Application to your spouse, alongside an Acknowledgement of Service.
  • You will receive a Notice of Proceedings.
  • Your spouse will then respond to the Divorce Application.

 

Step 3: Joint Application

  • The Court sends both parties a Notice of Proceedings.
  • Both parties will have 14 days to acknowledge receipt.
  • Both parties respond to the Divorce Application.

 

Step 4: Application for Conditional Order

  • After 20 weeks from the issuance of the Divorce Application, you can apply to the Court for a Conditional Order (formerly known as a Decree Nisi).
  • Note: At this stage, you may wish to delay applying for a Final Order if there are any financial claims to address.

 

Step 5: Application for Final Order

  • Six weeks and one day after the Conditional Order has been granted, you can apply to the Court for a Final Order (formerly known as a Decree Absolute).
