Our client, a landlord, was facing significant financial strain due to a tenant’s consistent failure to pay rent. Despite numerous attempts to resolve the issue amicably, the tenant accumulated substantial rent arrears. In light of this situation, the landlord sought our expertise to evict their tenant.
The first step was to consider which Notice was most appropriate to serve on the tenant. Following a thorough review of the Tenancy Agreement and associated documents, a Section 8 notice under the Housing Act 1988 was served on the tenant in a manner compliant with all legal requirements. After the tenant failed to rectify the rent arrears within the notice period, we were required to initiate Court Proceedings. Our experienced Litigation team represented the Landlord in Court, presenting the case alongside all the documents which included a rent statement and evidence of the arrears.
The Court found in favour of our client and granted a possession order within the 14 days of the Hearing. The judgment included an order for the tenant to vacate the property, pay the outstanding rent arrears and fixed Court costs.
